NLRB approves union election rule

With ‘Solutions’ Like These, Who Needs Problems?

For years, the U.S. Chamber of Commerce has fought a provision that would give the IRS sweeping authority to hold hostage 3% of nearly every business transaction that takes place between the public and private sectors. The 3% withholding tax effectively grants the federal government an interest-free loan. Worse still, the costs and burdens of the provision far outweigh any benefits.
Yet lawmakers have repeatedly passed up opportunities to repeal this job-killing mandate. With unemployment stubbornly hovering around 9%, and this provision set to take effect in 2013, Washington needs to wipe the 3% withholding tax off the books once and for all. Small Businesses Lead the Way in Green Technology Innovation

It should come as no surprise that small businesses are leading the way in green technology innovation - and the statistics back that up. The Small Business Administration's Office of Advocacy released a report today that analyzed small business innovation and patents in the field of green technology, studying the difference between small and large firms.
The results are clear - while small firms hold about 8 percent of all U.S. patents, they have 14 percent of the green technology patents. These include over 32 percent of patents in smart grids and solar energy, and 15 percent of the total batteries and fuel cell patents. Moreover, the report found that small innovative firms are 16 times more productive than large innovative firms when you look at patents per employee. Additionally, their patents are cited 2.5 times more than their large counterparts.

The state’s economic development agency has agreed to enter into negotiations over a sale price and tax incentives with a development company that plans to build a 600,000 square foot, state-of-the-art film and television production complex in Devens.
After declining to release details following a unanimous board vote a week ago, MassDevelopment officials on Thursday elaborated on plans to move ahead with MJM Development LLC of Andover, which plans to build the studio complex, including four 18,000 square foot sound stages, over ten years.

July 2011 - PATRICK SIGNS MUNI-HEALTH BILL

Gov. Deval Patrick on Tuesday signed into law municipal health insurance reforms that lawmakers have debated for years, providing a new option for cities and towns to make health plan changes under a new process. Under the new law, which proponents claim will help cities and towns collectively trim their own costs by $100 million, municipalities may opt for an expedited collective bargaining process to negotiate new benefit plans for employees.
If municipalities and unions fail to reach agreement in 30 days under that process, the case would be submitted to a three-person review panel for resolution - a panel that would include one union appointee, one municipality appointee and an appointee selected by the Secretary of Administration and Finance, a post controlled by the governor. The three-person panel would need to resolve matters within ten days.
According to Patrick's office, municipalities will be able to use the process to adopt copayments and deductibles and other cost-sharing health plan features that are not higher than those offered by the state-run Group Insurance Commission. Municipalities may also transfer employees into the state-run plan if it would result in at least a 5 percent savings compared to the local health care plan.
The reform allows a portion of savings to be returned to employees and includes protections for retirees and employees with existing health concerns who are likely to incur higher copayments, according to the administration. Patrick signed the bill in the Governor's Council chamber at a ceremony attended by Senate President Therese Murray, House Speaker Robert DeLeo, Boston Mayor Thomas Menino, as well as other state lawmakers and labor and municipal officials.

The Mass Taxpayers Foundation has just released the analysis of a Senate amendment that requires municipal contributions for retirees be the same as for active employees. Under this provision, all communities would have their hands tied in controlling unaffordable retiree health care costs and dozens of communities statewide would immediately lose the benefits of municipal health reform because of increased costs for retirees. House and Senate conferees are negotiating a final version of municipal health reform to send to the Governor as part of the 2012 budget.

Municipal Reform Efforts

U.S. House Passes Version of 1099 Repeal

The United States House of Representatives voted 314-112 today to repeal a provision of the health reform law that would have required businesses to file 1099 tax forms for every vendor that sold them more than $600 worth of goods and services.
Seventy six House Democrats joined a unanimous group of Republicans in supporting H.R. 4, which would offset lost revenue from the repeal by increasing the amount of health insurance subsidies that could be recaptured in cases where a family's income exceed certain thresholds.
Freshman Congressman William Keating was the only member of the Massachusetts delegation to vote on favor of the bill.
The Senate approved a separate version of the 1099 repeal on February 2. House and Senate will now attempt to reconcile the different revenue offset plans contained in the two versions. President Obama has indicated that he supports a 1099 repeal, but has problems with the House bill.
The 1099 mandate, due to take effect in 2013, would require more than 30 million U.S. companies that currently only have to tell the IRS the value of services they purchase from vendors to also report the value of goods and merchandise they purchase. Lawmakers added the 1099 reporting footnote to the federal health reform bill in an effort to fund a portion of the massive overhaul.
Associated Industries of Massachusetts believes the provision would saddle employers with significant administrative and accounting expense at a time when many are already struggling with the soft economy.

As you may be aware, Chapter 165 of the Acts of 2010, "An Act Further Regulating Public Charities" (the "Act"), modifies some of the Office of the Attorney General's ("AGO") current filing requirements for the Non-Profit Organizations/Public Charities Division ("Division"). This email outlines the changes in filing requirements for public charities and professional fundraisers and discusses the new dissolution guidelines made effective earlier this fall. This email also discusses the AGO's recent decision to modify the requirement to submit a Federal Form 990-EZ for organizations whose annual gross support and revenue is less than or equal to $5,000.

The Internal Revenue Service released instructions and new income-tax withholding tables to help employers implement the provisions of H.R. 4853, Tax Relief, Unemployment Insurance Reauthorization, and Job Creation Act Of 2010. Employers should start using the new withholding tables and reducing the amount of Social Security tax withheld from employees as soon as possible in 2011 but not later than Jan. 31, 2011.

April 2010 - What Businesses Need to Know About the New Health Care Law & Implementation
The timeline for the new health care legislation, passed by Congress and signed into law last month, sees many reforms go into effect 2014 with other aspects coming even later. The various government agencies, particularly the Department of Health and Human Services and Internal Revenue Service, will be working over the next several years on drafting the regulations necessary to implement the new laws, and it will be through this process that we’ll work to change and improve the regulations to help businesses.
